Charandas Swami vs State of Gujarat & Anr

Bench: 2 — A.M. Khanwilkar

In Brief

Three accused appealed against their conviction for the murder of Gadadharanandji, Chairman of the Board of Trustees of Swami Narayan sect. The deceased proposed transferring the accused (Kothari staff) away from the temple due to suspected financial irregularities. He went missing on 3 May 1998 and was found dead at Barothi village, Rajasthan, on 4 May 1998. The Supreme Court upheld concurrent findings of guilt on circumstantial evidence, including the deceased being last seen with accused No. 3, disclosure by accused No. 5 of the crime location, recovery and identification of the body, and evidence of conspiracy. The convictions and life sentences imposed by the High Court were affirmed.
