The appellant sought a permanent injunction to prevent the defendants from constructing a shed on a common pathway after partition of ancestral property. Both the trial court and High Court found the suit defective. The Supreme Court upheld the dismissal, holding that the plaintiff failed to join other parties whose interests in the pathway were affected. The suit was also based on an inaccurate plan that did not properly describe the parties' rights, and the disputed area did not fall within the plaintiff's property. Non-joinder of necessary parties was fatal to the suit."
