The appellant sought a permanent injunction to prevent construction on a common pathway shared between two parcels of land divided by partition deed in 1951. Both the trial court and high court dismissed the suit, finding that: (1) the appellant had failed to join other parties who purchased land from either side and had an interest in the pathway; (2) the plaint's plan was inaccurate and did not properly describe the roads or parties' rights; and (3) the disputed construction did not fall within the plaintiff's area. The Supreme Court upheld the dismissal, holding that non-joinder of necessary parties is fatal to the suit and cannot be overlooked.
