Nagar Palika Raisinghnagar appealed against orders of the First Appellate Court and High Court that granted permanent injunction to Rameshwar Lal, a respondent claiming ownership of a 100×100 sq. ft. plot based on a Patta (land grant) issued to his grandfather in 1957. The Nagar Palika denied valid allotment and claimed the grant was cancelled with refund. The Supreme Court held that the Nagar Palika failed to prove cancellation or refund by evidence. Since the respondent held the Patta and was in possession, all three ingredients for permanent injunction were satisfied. Concurrent findings of the two lower courts were binding. The appeal was dismissed."
