Chidambaram vs Spl. Tahsildar Land Acquisition & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court allowed an appeal challenging the High Court's fixation of land value at Rs. 8 per sq. foot for land acquired under Notification dated 22.05.1991. The Court found that the appellant's land should receive the same treatment as similar acquisitions under Notifications dated 15.04.1991, 16.04.1991 and 27.05.1991. Using a contemporaneous sale deed (8-2-1991) as the base document at Rs. 30 per sq. foot, and applying a one-third discount, the Court fixed the land value at Rs. 20 per sq. foot, ensuring equitable treatment across similarly situated landowners.
