In Brief
The Commissioner of Madurai sought to take action against a builder (Ismail) for alleged construction violations. The builder claimed he had permission from the Standing Committee. The Supreme Court held that only the Director of Town and Country Planning has authority to decide matters involving construction violations exceeding 2000 sq. ft. The Court directed the Director to hear all parties and decide the matter on merits, without being bound by the Municipal Corporation's prior observations. The builder's argument that 2010 regulations should not apply retrospectively to his 1964 building was left open for consideration before the Director. The Court restrained the Corporation from taking coercive action pending the Director's decision."
