In Brief
A municipal corporation sought to prevent unauthorized construction that exceeded 2000 sq. ft., allegedly violating town planning rules. The builder claimed permission was granted by the Standing Committee. The Supreme Court held that for violations exceeding 2000 sq. ft., only the Director of Town and Country Planning (not the Municipal Corporation) has power to regularize such violations under the Tamil Nadu Town and Country Planning Act, 1971. The Court directed the Director to hear all parties and decide the matter on merits within six months, and restrained the Corporation from taking coercive steps pending that decision.
