Commissioner/Secretary to Govt. Education Department, J and K & Ors. etc vs Mohd Amin Waza & Anr. etc

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court addressed whether the Jammu & Kashmir Department of Education violated a High Court direction to consider Mohd. Amin Waza's application for a teacher post. The Department had considered his application and rejected it (34.75 points vs. 49.83 for the selected candidate). The respondent filed a contempt petition alleging non-compliance. The Court held that the High Court's direction was limited to 'consider' the case, which the Department did. Since consideration occurred and resulted in a reasoned decision—albeit unfavourable—there was no willful disobedience. The Court set aside the contempt proceedings, holding that contempt cannot be initiated merely because the outcome was unsatisfactory."
