Common Cause & Ors vs Union of India & Ors

Bench: 3 — Madan B. Lokur

In Brief

This judgment addressed whether to appoint an outside investigative body to probe alleged abuse of authority by the then CBI Director in coal block allocation cases. The petitioner sought investigation into meetings the Director held with accused persons without investigating officers present. The Court, noting a change in CBI leadership, decided to entrust the investigation to the CBI itself through a Special Investigating Team. Finding a prima facie case of abuse of authority based on a Committee report, the Court directed the CBI Director to form an SIT with specified officers and external legal assistance to investigate whether the former Director attempted to scuttle ongoing cases."
