The Supreme Court held that Non-Governmental Organisations substantially financed by the appropriate government are covered under the definition of 'public authority' in Section 2(h)(ii) of the Right to Information Act, 2005. The term 'substantially' means a large portion but does not necessarily require funding exceeding 50%. The court dismissed the appeal of one NGO receiving less than 50% but substantial government funding, and remitted other appeals for determination of whether the organisations in question were substantially financed by government according to this flexible standard.
