The Delhi Transport Corporation appealed against the retirement of employees under the Voluntary Retirement Scheme, contending that their leave-without-pay periods should not count toward the ten-year qualifying service for pension. The Supreme Court held that no adverse effect on pension rights can be imposed without prior notice to the employee via service book entry or otherwise. Since no such notice was given, it would be unjust to deny pension after employees retired based on completing ten years of service. The Court found that an earlier precedent (DTC v. Lillu Ram) required reconsideration by a larger bench, and expedited the hearing given the interim payment of only 50% pension.">
