Daddy’s Builders Pvt. Ltd. & Another vs Manisha Bhargava and Another

Bench: 2 — M.R. Shah

In Brief

Builders and another challenged dismissal of their application seeking condonation of delay in filing a written statement in a consumer complaint. The written statement was filed beyond the 45-day statutory period under the Consumer Protection Act, 1986. The Supreme Court held that consumer forums have no jurisdiction to accept written statements filed beyond this period. While forums may, in appropriate cases on suitable terms, accept late filings, they are not mandated to do so. The Court dismissed the petition, confirming the National Commission's rejection.
