Daulat Singh Rathore vs Rajasthan Housing Board

Bench: 2 — Abhay Manohar Sapre

In Brief

A citizen applied in 1982 for a flat under the Rajasthan Housing Board's Middle Income Group scheme but faced delays and disputes. After the MRTP Commission dismissed his unfair trade practice complaint, he appealed to the Supreme Court. Rather than decide legal merits, the Court directed the Board to reconsider his case fairly and allot him a flat, with the purchase price adjusted for amounts already paid plus interest. The Court gave a 6-month deadline to complete formalities, allowing him to add a blood relative as co-owner if desired. The appeal was disposed with concrete relief.
