Daulat Singh Rathore vs Rajasthan Housing Board

Bench: 2 — Abhay Manohar Sapre

In Brief

A man applied in 1982 for a flat under a Rajasthan Housing Board scheme but faced a protracted dispute over allotment and sale terms. After the MRTP Commission dismissed his unfair trade practice complaint, he appealed to the Supreme Court. Rather than adjudicate the underlying claims, the Court crafted an equitable solution: the Board must allot him a flat at current government price, credit his prior deposits of Rs 19,600 with 12% interest, and allow him to name a blood relative as joint co-owner. All formalities must complete within six months, failing which his deposits are forfeited. This brought closure to 35 years of litigation.
