In Brief
Two cooperative housing societies (Bankmens and Safdarjung CGHS) were revived decades after liquidation by persons who were not original members, and land was provisionally allotted to them. Members who paid contributions sought possession, but investigations by the CBI revealed the revivals were fraudulent, involving forged documents, fabricated membership lists, and builder mafia control. The Supreme Court held that revival by non-original members constitutes illegal revival. Since the foundation was fraudulent, neither Society could claim land allotment. The Court allowed the appeals and directed the DDA to refund all deposits with 10% interest to protect members who may have been duped.
