Dhamendra Kumar Sharma vs Somendra Babu (Since Deceased) through Lrs. & Ors

Bench: 2 — Kurian

In Brief

A tenant facing eviction from a shop challenged the High Court's eviction order before the Supreme Court. The landlord, who owned multiple shops including units in a new construction project, agreed to accommodate the tenant in one of the new shops. The Court facilitated a settlement whereby the tenant was to vacate within one month, the landlord would complete construction within three months and hand over the new shop at ₹10,000 per month for three years, and the tenant would clear all arrears before occupying the new premises. The appeal was disposed of on this agreed settlement.
