Raghubir Singh Bisht (D) Tr. Lrs. & Anr vs Raghunath Singh Negi & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court dismissed an appeal challenging eviction from commercial premises used as a hotel. Concurrent findings by the lower courts had gone against the appellants. Balancing the appellant's interest (the hotel being their sole livelihood source and long occupancy) against the respondent's long-standing need to recover possession (an ex-serviceman waiting over 30 years), the Court granted a reasonable extension to vacate by Diwali 2018, subject to conditions: continued rent payment, no subletting, no change of business, and filing of a binding undertaking with contempt liability for breach.
