Supreme Court of India 2017-03-29 disposed

Raghubir Singh Bisht (D) Tr. Lrs. & Anr vs Raghunath Singh Negi & Ors

Bench: 2 — Kurian

In Brief

A tenant running a hotel business challenged an order for eviction. The Supreme Court found concurrent findings of lower courts against the tenant. While sympathizing with the tenant's livelihood concerns, the Court balanced the rights of the landlord (an ex-serviceman seeking the premises for his own business). The appeal was disposed of by granting the tenant until Deepavali 2018 to vacate the premises, subject to strict conditions: no subletting, no new partners, no business change, continued rent payment, and filing of an undertaking. Non-compliance would invite contempt proceedings."
