Director General Central Reserve Police Force vs Cpl. Sunil Singh and Ors

Bench: 1 — Deepak Gupta

In Brief

Air Force personnel Cpl. B.S. Siddha and Cpl. Sunil Singh applied for Central Reserve Police Force posts without prior permission and before completing seven years' service, violating Air Force Orders. The High Court granted them relief on compassionate grounds, but awarded seniority from their selection date. The Supreme Court upheld the relief but modified seniority: these officers cannot claim seniority from when ineligible. Instead, seniority will be reckoned as the seniormost in their training batch. The Court distinguished between compassionate relief and entitlement to service benefits based on ineligibility."
