In Brief
Two Air Force personnel applied for civil posts without obtaining required permission and before completing 7 years of service, violating Air Force orders. Though selected and later relieved on compassionate grounds after completing 7 years, the respondents sought seniority reckoning from their original selection. The Supreme Court held that ineligible applicants granted relief cannot claim seniority from when they were ineligible. Seniority must be fixed treating them as the senior-most in their training batch. The appeal was allowed.
