DLF Homes Panchkula breached its promise to deliver apartments within 24 months. Some homebuyers sought refunds; others wanted possession despite delays. The State and National Consumer Commissions directed refunds with interest and ordered possession to be delivered. On appeal, the Supreme Court confirmed that the developer is liable for deficiency in service and confirmed interest at 9% per annum, but modified the interest period to align with orders of the State Commission. The Court set out detailed principles for computing interest in refund cases (from date of deposit) and compensation in possession cases (after the three-year contractual period expires), accounting for transfers to subsequent purchasers and prior payments. The appeals were disposed of based on these agreed principles and a reconciled chart of amounts payable to each complainant."
