In Brief

The Supreme Court set aside the High Court's order quashing a recruitment advertisement for the Director post at the Regional Institute of Medical Sciences (RIMS), Imphal. The High Court had invalidated the advertisement on grounds including absence of age relaxation and non-conformity with Medical Council regulations. The Supreme Court held that the High Court erred in examining amended recruitment rules when not challenged, noting that duly approved rules need not be publicly notified to be enforceable. The Court found the prescribed experience criteria compliant with regulations for affiliated teaching hospitals. It also held that relaxation of eligibility criteria is within the employer's discretion and cannot be compelled by courts. The appeals were allowed and the writ petitions dismissed.
