The Delhi Transport Corporation challenged an Industrial Tribunal Award that granted revised pay-scales to its security staff, bringing them into parity with Delhi Police ranks. The Supreme Court upheld the High Court Division Bench's decision to set aside the Award. The Court held that fixation of pay-scales is a complex, technical matter requiring Pay Commission expertise, not Tribunal adjudication. While acknowledging historical parity for higher ranks, the Court found the Tribunal could not simply extend parity to lower ranks based on equal work alone, especially where a dedicated Commission was examining the issue. Implementation would create cascading effects harming other employees, and the financial implications for the Government made judicial intervention inappropriate.
