Bihar State Beverages Corporation (a government company with no permanent employees, only deputation and contract staff) issued an advertisement in 2006 offering pay scales per the 5th Pay Revision Committee. After initially agreeing in 2010 to grant the 6th PRC benefits, the Corporation's 2012 resolution instructed deputation employees to receive their parent organisations' pay scales instead. The Supreme Court upheld the High Court's decision quashing this resolution, holding that employees performing identical work on the same post must receive equal pay. Finance Department advice limiting 6th PRC benefits to non-existent permanent employees was unreasoned. However, the 6th PRC scales apply only during employment with the Corporation; upon repatriation to parent organisations, employees receive those organisations' scales.
