A union sought revision of pay-scales for security staff (Assistant Security Officer, Havaldar, and Guard) at Delhi Transport Corporation to achieve parity with Delhi Police. An Industrial Tribunal granted parity in 1985 based on similar duties and existing parity for higher ranks. The DTC challenged this before the High Court. A Division Bench set aside the Award. The Supreme Court upheld the Division Bench, holding that pay-scale fixation is the exclusive function of the Government and Pay Commission, not Tribunals. Though Tribunals must protect industrial peace, they must exercise restraint on such complex matters to avoid cascading complications and anomalies. The appeal was dismissed."
