Dumka Medical College, Dumka & Another vs Board of Governors in Supersession of Medical Council of India & Another

Bench: 2 — L. Nageswara Rao

In Brief

The Supreme Court dismissed writ petitions challenging the Medical Council of India's rejection of applications for establishing three new medical colleges in Jharkhand (at Dumka, Hazaribagh, and Palamu). Although the State had filed affidavits claiming deficiencies were rectified, subsequent MCI inspections revealed persistent gross shortages in faculty (50–100%), nursing staff, infrastructure, and clinical materials. The Court held that admission to medical colleges lacking basic standards cannot be permitted, regardless of affidavits filed or seat availability. The State was directed to rectify all deficiencies and reapply for renewal for the academic year 2021–2022.
