Dwarika Das Rathi vs State of Chhattisgarh

Bench: 2 — Kurian

In Brief

An accused in a case involving alleged misappropriation of rice mill produce (deficit of Rs.2,71,34,937) sought interim protection under Section 438 Cr.P.C. The Supreme Court made absolute the protection previously granted in January 2017, conditioned on deposit attempts and property attachment. The Court permitted attachment of all immovable property and bank accounts, directed the trial court to account for deposits made at conclusion of trial, and allowed the accused to challenge the quantum of the alleged deficit. The investigation was permitted to continue, and the interim protection was confirmed pending final trial proceedings."
