Supreme Court of India 2017-01-11 remanded

Hoshiar Singh (D) Thr. Lrs & Ors vs State of Punjab & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court remanded multiple civil appeals concerning land compensation for the Ranjit Sagar Dam project. Landowners had applied to adduce additional evidence showing compensation awards for comparable land in Jammu & Kashmir and Himachal Pradesh, but the High Court rejected this without formally ruling on the applications. The Court held that unless a court explicitly orders on the reception or rejection of such evidence, it cannot claim no evidence exists. The High Court must reconsider afresh, first properly deciding the applications under Order 41, Rule 27 CPC, then determining fair compensation.
