Eregowda @ Vasu vs Divisional Manager, United India Insurance Co. Ltd. and Another

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A driver suffered injuries in a December 1999 accident, resulting in left-arm damage, weakness, restricted movement, and shortening. Medical experts assessed 52% physical disability. The Workmen's Compensation Commissioner initially awarded compensation based on 50% loss of earning capacity. The Supreme Court held that although the physical disability was 52%, the appellant's complete inability to continue driving amounted to 100% loss of earning capacity. The Court modified the award to recognize total loss of earning capacity, requiring the Commissioner to recompute compensation and the insurer to pay the balance with 6% interest.
