Eregowda @ Vasu vs Divisional Manager, United India Insurance Co. Ltd. and Another

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A driver suffered permanent injuries to his left arm and hand in a 1999 accident, including a malunited fracture, absent bone, arthritis, and restricted movement. Although assessed at 52% physical disability, the Supreme Court held that functional inability to work as a driver warranted 100% loss of earning capacity. The Court modified the award and directed recomputation of compensation at Rs. 4,500 per month (100% loss) rather than 50%, plus 6% interest, distinguishing between medical disability percentage and actual work capacity for a skilled profession."
