Supreme Court of India 2021-11-10

Executive Engineer, Gosikhurd Project Ambadi, Bhandara, Maharashtra Vidarbha Irrigation Development Corporation vs Mahesh and Others

Bench: 2 — Sanjiv Khanna

In Brief

The Supreme Court held that when land acquisition proceedings initiated under the 1894 Act have no award as of the 2013 Act's commencement, the twelve-month limitation period under Section 25 of the 2013 Act applies, not the two-year period under Section 11A of the 1894 Act. The twelve-month period runs from 1st January 2014, and time spent under court stay orders is excluded. The Court upheld an award purportedly dated 30th October 2014 as valid, noting that even if backdated, it was made within the extended timeline after accounting for the court-ordered stay period.
