Foundation For Organisational Research & Education "Fore School of Management" vs All India Council For Technical Education (AICTE)

Bench: 2 — 2

In Brief

FORE School of Management sought to retain an approved increase in student intake in its PGDM-IB program from 60 to 120 seats. AICTE had sanctioned the increase on 10 April 2017, and the college admitted students on that basis. However, AICTE withdrew the increase on 21 April 2017, citing pending accreditation renewal from the National Board of Accreditation. The college obtained accreditation on 18 May 2017. The Court held that once an authority sanctions an increase and institutions make legitimate admissions relying on it, withdrawal cannot be justified by accreditation delays caused by the regulatory body itself. The corrigendum was set aside and the increased intake restored.
