Subharti Medical College vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A medical college sought increase in post-graduate seats in Ophthalmology and Orthopedics. The Medical Council of India approved the increase, but rejected the application because the bank guarantee was submitted on 3 March 2017, after the stated deadline of 28 February 2017. However, the college received the directive letter only on 28 February and submitted the guarantee within three days. The Supreme Court held that the delay was beyond the college's control and the respondents' two-month delay in issuing rejection was unreasonable. The Court allowed the petition and directed acceptance of the bank guarantee and implementation of the approved increase in seats."
