G.D.A. & Anr vs Mithilesh Goel

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Ghaziabad Development Authority allotted a house to Mithilesh Goel in 1993 at an estimated cost of Rs. 5,40,000. Seven years later, the Authority raised the final cost to Rs. 6,42,464 and kept increasing the demand. Goel complained to the Consumer Commission alleging unfair trade practice. The Supreme Court set aside the Commission's order, holding it had no jurisdiction. The allotment of an immovable property (house) does not involve goods or services covered by the MRTP Act's unfair trade practice provisions. Additionally, an estimate that is later revised does not constitute false representation. The appeal was allowed."
