Ganga Pal vs State of Madhya Pradesh

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Ganga Pal was arrested in connection with the death of his daughter-in-law based on the investigating officer's report implicating him. However, when the Supreme Court reviewed the dying declarations of the deceased woman, they contained no accusations against Pal. The Court held that dying declarations exonerating an accused person should carry greater weight than investigative findings for bail purposes. Accordingly, the Court granted bail to Pal, satisfied that the absence of allegations in the dying declarations was a significant factor favouring his release pending trial."
