In Brief
Gargi was convicted by the trial court and High Court for conspiracy to commit murder (Sections 120B and 302 IPC), while her brothers were acquitted. On appeal to the Supreme Court, the conviction was set aside. The Court found that the investigating agency failed to include independent witnesses and conducted inquiries only among the appellant's in-laws. The trial and High Courts were held to have overlooked significant investigative flaws. The Court held that while suspicion existed, the prosecution did not establish a complete chain of incriminating circumstances by cogent evidence. The appellant was entitled to the benefit of doubt and was acquitted.
