Gautam Singhania vs Hari Shankar Singhania and Ors

Bench: 2 — 2

In Brief

In this special leave petition, the Supreme Court directed the petitioner (Gautam Singhania) to hand over possession of Kamala Cottage, a property in Mumbai, to the respondents within 48 hours. The respondents were required to deposit ₹20 crores as security with the Court Registry before taking possession. Execution proceedings pending before the District Judge were transferred to the Supreme Court for consolidated hearing. The Court made clear that any obstruction to the property handover would constitute contempt of court, thereby enforcing compliance with its order.
