The Ghaziabad Development Authority acquired 386 acres in Village Jatwara Kalan. The Land Acquisition Collector awarded compensation at Rs. 1.92 per sq.yd. for land near the highway, declining with distance. A reference court fixed Rs. 40 per sq.yd., but the High Court enhanced this to Rs. 85 per sq.yd., relying on the Anoop Singh case. The Supreme Court held that Anoop Singh's case was distinguishable because his land was strategically located near the highway and within Ghaziabad's Municipal Area, while the respondents' land was interior and outside the Municipality. The Court reduced compensation to Rs. 42.50 per sq.yd.—a 50% reduction from the High Court's award."
