Glocal Medical College and Super Speciality Hospital and Research Centre vs Union of India & Anr

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

In this batch of writ petitions filed by private medical colleges and super-speciality hospitals challenging the Medical Council of India's refusal to grant permission for certain operations or expansions, the Supreme Court found mixed merit. Where the government had subsequently granted approval, the Court disposed of the petitions. One petition (Writ No. 477/2017) was dismissed as having no merit. For other petitions (particularly Writ No. 450/2017), the Court directed the Union of India to provide a detailed affidavit explaining the consistent criteria and basis for granting similar permissions to other institutions, to assess whether the refusal was arbitrary or discriminatory. The Court restrained encashment of bank guarantees pending resolution."
