The Government of Delhi appealed against the dismissal of land acquisition proceedings against Kishan Chand. The Court found the acquisition proceedings defective and unsustainable on the same principles established in earlier cases involving the Delhi Development Authority. The appeals were dismissed. However, the Government was granted one year to initiate fresh acquisition proceedings under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Failure to do so within this period would result in the land being returned to its original owner.
