Govt. of NCT of Delhi vs Vikas Gupta and Ors

Bench: 2 — Kurian

In Brief

The Government of NCT of Delhi appealed a decision dismissing its land acquisition proceedings against Vikas Gupta. The Supreme Court dismissed the appeal, following its earlier judgments against the Delhi Development Authority on the same issue. However, the Court granted the Government a one-year period to reinitiate fresh acquisition proceedings under Section 24(2) of the Land Acquisition, Rehabilitation and Resettlement Act, 2013. If no new acquisition notice is issued within this period, the Government must return possession of the land to the original owner.
