Govt. of NCT of Delhi and Another vs Mahender Singh and Others

Bench: 2 — Kurian

In Brief

The Delhi Government challenged a High Court order declaring that land acquisition proceedings had lapsed under Section 24(2) of the 2013 Act. The Government argued that a stay order granted for adjoining land should benefit all lands covered by the same acquisition notification. The Supreme Court held that Section 24(2) lapse (post-award, when compensation/possession not effected within five years before 01.01.2014) affects only the specific land in the award, not the entire notification. A stay in one matter cannot extend to other lands. The Court distinguished the situation from pre-award lapse under Section 11A. The appeal was disposed, with a one-year period granted to initiate fresh proceedings under the 2013 Act.
