Shivaji Shamrao Patil & Ors vs Special Land Acquisition Officer

Bench: 2 — Kurian

In Brief

This case concerns lapse of land acquisition proceedings under the 2013 Fair Compensation Act. An award was passed in 1988 but no actual compensation was paid to the landowners (appellants) before the 2013 Act came into force on 1 January 2014. The Supreme Court held that since compensation was undelivered five years before the Act's commencement, the proceedings lapsed under Section 24(2). Mere deposit in a government treasury does not constitute actual payment. The Court granted the respondents one year to restart acquisition proceedings if they wished to do so.
