In Brief
Guman Singh was convicted of murder (Section 302 IPC) and attempt to murder (Section 307 read with Section 34 IPC) based on eye-witness testimony. The Supreme Court set aside the conviction, finding that key witnesses (son and nephew of the deceased) were not present at the crime scene when police arrived, but appeared 3 hours later at the hospital claiming to be eye-witnesses. The injured witness did not identify the appellant. Weak forensic evidence and absence of corroboration further undermined the prosecution case. The Court held that unreliable eye-witness testimony cannot support conviction without substantial independent corroboration.
