The conviction rested primarily on eyewitness testimony from Tara Singh and Varun Singh, who claimed to have seen the shooting. However, the Court found their testimony wholly unreliable: they were not present at the scene when police arrived three hours after the incident, their accounts contradicted the investigating officer's testimony, and the injured eyewitness (Babu Singh) did not identify the appellant or corroborate their version.
