Guman Singh was convicted of murder under Section 302 IPC and attempt to murder under Section 307 IPC based on eyewitness testimony of two relatives of the deceased. The Supreme Court set aside the conviction, finding that the eyewitnesses (Tara Singh and Varun Singh) were wholly unreliable: they were not found at the crime scene by the investigating officer and police, yet claimed three hours later to have witnessed the attack. The injured eyewitness (Babu Singh) did not corroborate their presence or identify the appellant. Weak forensic evidence could not support the charge. With other co-accused acquitted and no credible corroboration, guilt was not proved beyond reasonable doubt. The appeal was allowed and the appellant released."
