The Supreme Court dismissed appeals by the State of Madhya Pradesh, Gwalior Development Authority, and three employees challenging the seniority and absorption of Subhash Saxena, an assistant engineer. Saxena, initially appointed to SADA Malajkhand in 1982 and promoted in 1987, was transferred to GDA in 1988. The Court held the promotion and transfer valid under the applicable rules. The Court found Saxena was absorbed into GDA, as shown in the 2003 Gradation List. The private respondents were barred by finality of earlier dismissed special leave petition and subsequent review and curative petitions. Given time lapse and res judicata principles, the Court declined interference.
