GWALIOR DEVELOPMENT AUTHORITY GWALIOR vs SUBHASH SAXENA & OTHERS

Bench: 2 — K.M. Joseph, S. Ravindra Bhat

In Brief

This case involved disputes over the seniority and absorption of an employee transferred from SADA Malajkhand to Gwalior Development Authority (GDA). The Court upheld the High Court's decision that the employee's 1987 promotion as Assistant Engineer was valid and that his subsequent transfer to GDA in 1988 was a proper transfer (not deputation). The Court found that after 18+ years of continuous service, the employee's status as a GDA employee could not be retroactively altered. However, the Supreme Court dismissed the appeals on procedural grounds, noting that the dismissal of earlier Special Leave Petitions and Review/Curative Petitions by the private parties precluded further litigation on substantially the same issues.",
