Hamdard Laboratories vs Haryana State Industrial and Infrastructure Development Corporation and Ors

Bench: 2 — Kurian

In Brief

In this appeal, Hamdard Laboratories challenged the High Court's decision on entitlement to a 20% rebate on additional land costs paid to the Haryana State Industrial and Infrastructure Development Corporation (HSIIDC). The Supreme Court held that the appellant is entitled to the 20% rebate as it is included in the enhanced cost of land and there is no restriction in the notification preventing such rebate, even though compensation had already been paid. The Court directed the corporation to pay the amounts due within two months. The appeal was allowed.
