HAMMAD AHMED vs ABDUL MAJEED

Bench: 2 — L. Nageswara Rao, Hemant Gupta

In Brief

Hammad Ahmed, as Chief Mutawalli of Hamdard Laboratories, sought an order to operate the institution's bank accounts as sole signatory and to prevent others from interfering in its management. The Supreme Court dismissed the application. It clarified that an earlier judgment contained an inadvertent error: the word 'management' should read 'banking operations'. The institution's bank accounts are governed by a 2015 Board resolution requiring joint signatures from both constituent groups. The Chief Mutawalli does not have exclusive banking rights; the voluntary arrangement for combined signatures must continue to protect the interests of both groups and preserve Hamdard's legacy.
